Cardiac Automated External Defibrillators (AED's)

For All NYSPHSAA Member Schools 

In May 2002 legislation was enacted to add a new section 917 to the Education Law requiring school districts, BOCES, county vocational education and extension boards, and charter schools to provide and maintain on-site, in each instructional school facility, at least one functional automated external defibrillator (AED) for use during emergencies. The legislation also requires public school officials and administrators responsible for such school facilities to ensure the presence of at least one staff person who is trained in the operation and use of an AED. 

Legislation 

Education Law section 917 becomes effective September 1, 2002. However, in July 2002, the New York State Legislature passed an amendment to that law which allows school districts, BOCES, county vocational and extension boards, and charter schools that are unable to comply with the AED legislation by September 1, 2002 to delay implementation until December 1, 2002. Those wishing to delay implementation should certify to the Commissioner of Education that they are unable to comply by sending a letter to Commissioner Mills. 

Requirements 

The legislation requires public school officials and administrators responsible for public school facilities to ensure the presence of at least one staff person who is trained in the operation and use of an AED: 

  • whenever public school facilities are used for school-sponsored or school-approved curricular or extracurricular events or activities, or 
  • whenever a school-sponsored athletic contest is held at any location. 
Where a school-sponsored competitive athletic event is held at a site other than a public school facility, the public school officials must assure that AED equipment is provided on-site. 

For All Non-Public NYSPHSAA Member Schools 

The NYSPHSAA is committed to the health and safety of all its member schools, public and non-public. On August 9, 2002 the NYSPHSAA Central Committee approved the following motion effective immediately. 

All New York State Public High School Athletic Association member schools shall comply with the automated external defibrillator (AED) regulations pursuant to Section 917 of Education Law as it pertains to athletic events, practice and competition. 

According to the regulation school districts are required to comply by September 1, 2002. However, in August the Governor signed an amendment which allows school districts who are unable to comply with the AED legislation by September 1, 2002 to delay implementation until December 1, 2002.
